Question

Aslkm. I am married but not by Civil. I bought a land and construct a house in it all expenses bear by me. My husband has his home and a piece of agricultural land by heritage. He has now bought a land for himself. We have no children. I want to make a testament before I die. I want to know whether my husband has a right in my wealth. Should I include his name? I have a mother and 2 brothers. How should i distribute my wealth by Shariah?

Answer

Wa Alaikumus Salaam Wa Rahmatullah
According to Shariah if something belongs to you, your husband (if you were still in his Nikah) will be entitled to 1/2 of your estate.
1/6 will go to your mother, the remainder to your brothers. If you have intention to make any will to anybody who is not your inheritor so you have
the right to do it to the extent of 1/3 of what will remain after burial expenses and debts paid off.
